Terms and Conditions  

In these Conditions the following terms shall have the meaning assigned below;

'The Owner', 'We', or 'Us' shall mean The Owners of Sunsets at Sanctuary, Davenport, Florida.

'You' or 'Guest(s)' shall mean the persons signing this form and shall be deemed to include jointly and severally those other persons on whose behalf the booking is made. The person signing the booking form agrees to take responsibility for the party occupying the property.

This property is privately owned and is our home. We expect all guests to enjoy the facilities and treat the property with the same respect that they would their own home.

1. Any request for a booking will be only be considered confirmed upon receipt of a completed booking form and deposit which must be received within 3 calendar days.

2. A 20% deposit is required with the completed booking form. Confirmation will then be provided by email within 5 working days.

After a confirmed booking has been accepted by the owner any changes to the number of guests wishing to book must be requested in writing. Any changes to the original booking will constitute a change to the terms of this booking, therefore a new booking form will be required and all additional guests will be charged £10.00 per night.

3. You will be liable for any damages which arise to the villa during in your stay which were as a result of malicious or avoidable damage. As a result, we reserve the right to pursue you for further monies over and above the amount of the security deposit.

4. The final balance is payable 12 weeks prior to the date of arrival at the villa and when payment has been received all necessary information will be given to you.

5. Any booking made within 12 weeks of the date of arrival will require full payment to made at time of booking.

6. You may cancel your booking at any time after it has been confirmed and we require this cancellation to be made in writing. However, the booking is non-refundable, including the initial deposit.

 Guests must ensure they have taken out adequate travel insurance at the time of booking.

If no payment has been received for the final balance after the required due date of 12 weeks prior to the date of arrival we reserve the right to cancel the booking.

7. The villa will be available from 4pm on the date of arrival and guests must depart the villa by 10am on the date of departure. If the villa is not vacated after 10am on the date of departure, without prior consent, additional costs may by incurred.

8. We, or the Property Management Company cannot be held responsible, or liable for any cancellation of the property, or the loss, or damage caused by force majeure (such as, but not limited to, war, strike, riot, epidemic or pandemic or any other events beyond our control)

9. We, or the Property Management Company do not accept any liability whatsoever for death, personal injury accidents, loss or damage to persons or personal effects however caused.

10. IT IS STRONGLY RECOMMENDED THAT GUESTS TAKE OUT ADEQUATE HOLIDAY INSURANCE TO COVER CANCELLATION FEES AND ANY OTHER COSTS WHICH MAY OCCUR.

 

11. We, or the Property Management Company reserve the right to enter the property at any time to undertake essential maintenance or for inspection purposes. This also extends to the pool area where pool services, and or the Property Management Company are required to undertake required maintenance at least once per week. 

 

12. We, or the Property Management Company cannot be held responsible for any ongoing construction, alterations to existing houses, or any noise as a result thereof on or around the housing development.

13. In the event pool heating is requested we cannot guarantee the temperature of the pool as this will vary according to different factors, the main one being the prevailing weather conditions.

14. In the event of pool heater breakdown, or other circumstances beyond our control, we (or our representative) will do our/his utmost to rectify the problem as soon as possible. In such an event no compensation will be paid.

15. The pool heater and filtration systems are set and run by our Management Company. It is a criminal offence to tamper with any of the settings and if any guests are found to have done so will have their booking terminated and all payments made in respect of the booking will be forfeited by the said guests and their party. Our pool heater is monitored 24/7 by night vision cameras.                   Adult supervision is required at all times for children using the pool. Door alarms and a pool fence have been provided for the safety of you and your party.

Any damage caused to the pool blanket by careless removal or replacement, or damage to the pool blanket by children may affect the security deposit in the event of the requirement to purchase a replacement pool blanket.

NO BALLS ARE ALLOWED IN THE POOL AREA, except for the use of an inflatable beach ball. Any damage to the pool screen by guests by the use of any balls or other items will affect the security deposit for the replacement of any pool screens.

IMPORTANT – The integral spa cannot be heated separately and therefore in order for the spa to provide heat, pool heating must have been requested and included in the original booking.

16. No property is to be removed from the villa, any damages are to be reported to the Management Company immediately.

17. Please note that this is a non-smoking property and as such we do not allow smoking or vaping or anywhere in the villa itself or the pool area.

Our villa is licensed by the Florida State hotel licensing authority as a non-smoking building and compliance is mandatory. Any evidence of smoking found by our Management Company will result in the loss of security deposit and any monies due over and above the amount of the security deposit.

Please note that no drugs are allowed at all anywhere in the villa, pool area or any external areas of this property. This will result in immediate eviction and loss of all monies including the security deposit.

18. Please note that we do not allow any pets or animals within the villa or pool area. This extends to emotional support animals, and any pets belonging to any visitors of the guests. If any animals are found to be in the villa or pool area, the whole party will be asked to leave and all monies forfeited.

19. Only the persons named on the booking form are allowed to stay in the villa. The Florida State Law and State Fire regulations prohibit subletting, sharing or assigning. If persons not shown on the booking form are found to be in the property, the whole party will be asked to leave and all monies forfeited.

 

20. It is illegal to attempt to feed the Florida Sandhill cranes, alligators, raccoons and foxes. Under Florida Administrative Code 68A-4.001 it is a second-degree misdemeanour which is punishable by up to 30 days in jail and a $500 fine. Local wildlife officers do respond to any reports of citizens feeding any of the wildlife.

 

21. For the safety and protection of our guests this property is equipped with external night vision cameras at the front of the property including the driveway and to the side of the property monitoring pool heating controls and equipment.

 

22. The villa is located within a residential area and as such guests are required to respect neighbours at all times, keeping noise to a minimum. Please keep noise to an absolute minimum between the hours of 11pm and 7am. The rules of the Home Owners Association are such that a local sheriff can be called for excessive noise or disturbance levels which can result in eviction and a fine. All monies will be forfeited in such an event.

 

23. Any guests found to have accessed inappropriate material and/or downloaded such material during their stay will have their details relating to the date stamp of the offence passed to the authorities. Please ensure all guests in your party are made aware of this.

Any infringement of these rules during a guest’s stay will result in immediate eviction and loss of all rental monies.

 

24. The use of fireworks of any type – even as small as a sparkler is forbidden and will result in immediate eviction and loss of all rental monies. As the Floridian weather is hot and dry, brush fires and sparks to neighbouring properties could result in catastrophic damage.

 

25. Please be advised that all residents must adhere to the rules of the Home Owners Association concerning the parking of vehicles.

IMPORTANT Any vehicles which are parked on the grass in front of the homes, on the sidewalk, on the grass strip between the road and the sidewalk and on the street at night will be towed away by the towing company employed by the Homeowners Association to patrol nightly and the appropriate fee will be at the vehicle owner’s own expense.

26. Guests are prohibited from charging, or attempting to charge electric or hybrid vehicles from the electricity supply in the Property. Charging without permission will result in the whole party being asked to leave and all monies forfeited.

27. In the case of any unforeseen circumstances we reserve the right to cancel any booking and will only be liable to refund monies already paid by the Guest.
